In what cases will refusal follow?

Permission may be denied in the following situations:

It is clarified that if the actual place of residence of the individual (a disabled child together with his legal representatives) is changed and a request for the issuance of a “disabled person” badge is submitted to the ITU office located in the city where the applicant arrived, to the unit to which the person was previously attached, within an electronic request is sent within five days. If it is not possible to use electronic document management, it is sent by post in compliance with all the norms and rules established by the government of the Russian Federation regarding the safety of personal data of citizens. Who can install

The rules for using the “disabled person” sign of government decree No. 1990 say that this privilege can be used by:

  • drivers transporting disabled people (including those working in a taxi company);
  • the closest relatives of disabled children during their transportation.

Amendments to the legislative act say that if a person in need does not have his own vehicle or cannot drive a car, then the sign can be attached to any vehicle that transports the person. Sign "Disabled" on a car according to traffic rules

According to the traffic rules, the identification sign “Disabled” is a yellow square (150x150 mm according to GOST), in the center of which there is an image of the symbol of plate 8.17 “Disabled”. According to the requirements of the “Basic provisions for the approval of vehicles for operation...”, this identification mark, at the request of the driver, can be installed on a vehicle driven by a disabled person of groups I and II, as well as transporting disabled people of groups I and II or disabled children.

The location of the sign is not strictly regulated. But it should not limit the driver’s view and cover reflective elements, external lighting devices, other identification marks, license plate number (registration plate), etc.

In addition to the exceptions regarding prohibition signs, vehicles with a “Disabled Person” sign are provided with other benefits provided for by the “Disabled Persons” (8.17) and “Except Disabled Persons” (8.18) signs.

For example, the “Parking (parking space)” sign (6.4), installed together with plate 8.17, allows parking only for vehicles with the “Disabled Person” identification sign.

Finally, horizontal road markings 1.24.3 indicate the parking area for vehicles with the “Disabled” identification sign.

Parking here is only permitted for disabled vehicles. In case of violation of this norm, the driver must bear administrative liability in the form of a fine in the amount of 5,000 rubles (clause 2 of Article 12.19 of the Code of Administrative Offenses of the Russian Federation).

Mandatory confirmation of this status

The considered benefits for holders of the “Disabled” badge explain the desire of ordinary drivers to install it on their car. But in order to obtain the right to install such an identification mark, you must have supporting documents: a certificate of disability or a pension certificate with a disability mark. If the vehicle is used to transport disabled people or disabled children, then the person being transported (or his legal representative) must have a supporting document.

The obligation to prove disability is stated in clause 2.1.1 of the Russian Federation Traffic Regulations. A police officer may require a document confirming the fact of disability if the “Disabled” identification sign is installed on the car.

Fine for a “Disabled” sign installed illegally

If the driver, passenger or legal representative of a minor passenger cannot confirm the status of a disabled person, and the identification sign “Disabled” is installed on the vehicle, the administrative sanctions provided for in paragraph 2 of Article 12.4 of the Code of Administrative Offenses come into force. The penalty for illegally installing a “Disabled Person” identification sign is an administrative fine of 5,000 rubles for citizens. What should a driver do who is transporting a disabled person, but is currently moving without his participation? The issue is very complex, but the legislation does not interpret it in favor of the driver.

If the driver drops off a disabled person and continues driving without him, then theoretically he must dismantle (remove) identification signs. Otherwise, he is subject to administrative sanctions of paragraph 2 of Article 12.4 of the Code of Administrative Offenses (fine of 5,000 rubles), because cannot prove the fact of using the vehicle to transport a disabled person.
